Terms of Service

Please read these Terms of Service ("Terms") carefully before using CoverageMap.com or the CoverageMap mobile application (collectively, the "Services") operated by CoverageMap LLC ("CoverageMap," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 13 years of age to use the Services. By using the Services, you represent and warrant that you are at least 13 years old. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Services are intended for use in the United States and other jurisdictions where they are lawfully available. You are responsible for compliance with all local laws and regulations applicable to your use of the Services.

2. Accounts

You may use certain features of the Services without creating an account. To access account-based features, you may register using your Apple ID or Google account. You agree to provide accurate and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@coveragemap.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate your account if you violate these Terms or if we determine, in our sole discretion, that your account activity poses a risk to the Services or other users.

3. License to Use the Services

Subject to your compliance with these Terms, CoverageMap grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Services
  • Reverse engineer or attempt to extract the source code of the Services
  • Use the Services to develop a competing product or service
  • Use automated tools (bots, scrapers, crawlers) to access the Services without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to gain unauthorized access to any part of the Services or its related systems

4. User Contributions

4.1 Speed Test and Signal Data

By submitting speed test data or signal strength measurements through the Services, you grant CoverageMap a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such data for any purpose, including commercial purposes such as data licensing and the provision of API services to third parties.

You represent and warrant that any data you submit to the Services was collected in compliance with all applicable laws and does not violate the rights of any third party.

4.2 Background Data Collection

If you opt into passive background signal collection, you grant CoverageMap the same license described in Section 4.1 with respect to data collected through that feature. You may withdraw your consent to background data collection at any time by disabling the feature in app settings. Withdrawal of consent does not affect the lawfulness of data collected prior to withdrawal.

4.3 Prohibited Submissions

You may not submit data that:

  • Was collected using unauthorized means or in violation of any law
  • Infringes the intellectual property rights or privacy rights of any third party
  • Is false, misleading, or fraudulent

5. Data Practices and Privacy

Our collection, use, and sharing of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to our Privacy Policy.

You represent and warrant that any personal information you provide to the Services has been collected, stored, and transferred to CoverageMap in compliance with all applicable laws and regulations, including any notice, consent, or data transfer obligations applicable to you.

6. Intellectual Property

The Services and all content, features, and functionality thereof — including but not limited to the coverage maps, software, text, graphics, logos, and data compilations — are the exclusive property of CoverageMap or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Services or CoverageMap's intellectual property, other than the limited license expressly set forth in Section 3.

"CoverageMap" and associated logos and product names are trademarks of CoverageMap LLC. You may not use these marks without our prior written consent.

7. Third-Party Services and Links

The Services may integrate with or link to third-party services, including Apple Sign-In, Google Sign-In, and Google Analytics. Your use of those services is subject to the applicable third-party terms of service and privacy policies. CoverageMap is not responsible for the content, privacy practices, or accuracy of any third-party services.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COVERAGEMAP DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Coverage data presented through the Services is crowdsourced and user-generated. CoverageMap makes no representation or warranty as to the accuracy, completeness, or reliability of any coverage data. Coverage conditions vary and are subject to change.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COVERAGEMAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF COVERAGEMAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL COVERAGEMAP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT YOU PAID TO COVERAGEMAP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the foregoing limitations shall apply to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless CoverageMap and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) data you submit to the Services.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. You may opt out of arbitration within 30 days of first agreeing to these Terms by sending written notice to hello@coveragemap.com.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on the Services at least 30 days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination, the licenses granted to you under these Terms will immediately cease. Sections 4.1, 6, 8, 9, 10, and 11 shall survive termination.

You may terminate your account at any time by deleting it through the app or website. Account deletion is permanent and irreversible.

14. Digital Millennium Copyright Act (DMCA)

CoverageMap respects the intellectual property rights of others. If you believe that content on the Services infringes your copyright, please send a notice to:

Your DMCA notice must include: (a) a description of the copyrighted work you claim has been infringed; (b) identification of the infringing material and its location on the Services; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoverageMap with respect to the Services and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

You may not assign or transfer your rights under these Terms without our prior written consent. We may freely assign our rights and obligations.
